When a student sexually harasses his classmate after she reports having been raped, and the school allows the harassment to continue, the school violates Title IX. In Doe, the United States Court of Appeals for the Second Circuit affirmed the judgment in favor of the mother of a East Haven High School student whose peers sexually harassed her after the student reported that she had been raped. "Jane Doe" had brought a lawsuit against the East Haven Board of Education (the "Board") on behalf of her daughter "A.N." under Title IX of the Education Amendments of 1972 ("Title IX"). After a jury found in favor of Doe, the Board appealed. The Second Circuit ruled that the school board could be held liable for the harassment of A.N. under Title IX because the harassment occurred in the context of a reported rape and created a hostile educational environment.
