An employer violates an employee’s First Amendment Rights and freedom of speech when they terminate an employee who does not claim a political party and holds a non-policy making position. In Galli, the Third Circuit Court of Appeals decided that an employee’s First Amendment Rights and freedom of speech were violated when they considered whether the employer was aware that the employee failed to show public support for its officials and the political party in power.
