Mendez v. Puerto Rican Int’l Cos. et al., 2009 U.S. App. LEXIS (3d Cir. January 26, 2009)
The Third Circuit Court of Appeals held that in order for a party to be the subject of a mandatory stay pending arbitration under § 3 of the Federal Arbitration Act, 9 U.S.C. § 3, that party must have committed itself to arbitrate one or more issues in the suit. The Court affirmed the order of the District Court of the Virgin Islands denying suit.
