  Under False Claims Act, “Original Source” Must Have Firsthand Knowledge of Publicly Known Information

Rockwell International Corp. v. United States, 127 S. Ct. 1397 (March 27, 2007).

A plaintiff who merely predicts the events on which his lawsuit will eventually be based is not an “original source” for the purposes of the False Claims Act.  In Rockwell International v. United States, the United States Supreme Court ruled that a private person who brings an action against an entity under the False Claims Act when the allegations have been publicly disclosed must have “direct and independent knowledge of the information on which the allegations are based.” Because James Stone, the individual who brought the action, was determined not to have firsthand knowledge of this information, the Court reversed the judgment of the United States Court of Appeals for the Tenth Circuit to the contrary.
