The Zoning Board sits as a quasi-judicial Board. Its purpose is to provide relief from zoning requirements which cannot be satisfied. The requests for relief are not based upon policy, but rather upon the ability of an applicant to prove his or her case.
The Zoning Board is the Board of “non-permitted” uses and deals primarily with the issuance of variances, which are based upon the municipality’s zoning Ordinance. The zoning Ordinance establishes specific requirements for a land area within a municipality and regulates not only the uses permitted, but the size of the parcels, setbacks required, parking, signs, conditional uses and numbers other such regulations.
